Please tell me how you want your real estate handled when the last of you and your spouse (if jointly owned) are gone, for instance:
Would it be deeded to your children in equal shares?
Sold and the proceeds placed in trust for the care of your minor children?
Sold and the proceeds distributed equally, or per percentage to your children or other individuals?

Would you like your adult children to have the right of first refusal to purchase your real estate from your estate prior to listing it on the open market? (They can purchase the home from your estate at an agreed upon price prior to it being put up for sale to the public).

Normally your personal property would go to your spouse upon your death, however, you may specify other beneficiaries instead of your spouse. Please tell me in general how you want your personal property distributed (to my spouse, or, to my children, or, to so and so….). I will give you a Special Bequest Memorandum so you can list specific items you want to give to specific individuals (i.e., Ring to Molly, Boat to Kevin, Fishing gear to Margo, etc.)

Who would you like as your personal representative/executor? (Usually someone other than your spouse. Choose someone you trust to handle the paperwork, etc.) This person will file your wills with the county courthouse, put your home on the market, sell or distribute your personal property according to your Wills, set up trust funds for your minor children.

Would you like to name an alternate personal representative in the event your first choice predeceases you? Though not necessary, you can name one or more alternates.


If you have minor children, who would you like as guardian of your children? This person will care for your children if you and your spouse pass away while the children are still minors, or if you have a good reason for not leaving the children with the spouse after you pass away. If that is the case, please give me a few details (alcoholic, drug user, criminal, abuser, financially incompetent, etc.)


Would you like an alternate in the event your first choice is unable to act as guardian? Again, though not necessary, you can name one or more alternates.


Would you like the guardian, or the personal representative, or someone else to act as trustee of any trust fund for your minor children? This person controls the funds that are used to care for your children. The Trustee is the person your Guardian would come to for funds to raise the children. )



At what age would you like your beneficiaries to receive their share of your estate? You must choose the "age of adulthood" or older unless you would like a clause allowing for the release of funds for the purposes of higher education, to pay for tuition, room, board, books, (and even reasonable living expenses for college purposes only, if you want to include that.)


Would you like a clause to allow for payment of higher education as stated above?


If one of your beneficiaries passes away before you do, what would you like done with their share of your estate? Would it go to your surviving beneficiaries? Or to their spouse or children if any? Or to someone or something altogether different, like a charity or other relatives, friends, etc.?


Do your own a business? If so, what is the name of the business?

Are you a sole proprietor or partnership? If partnership, do you have a partnership agreement that has a death clause in it?

In regard to your Powers of Attorney for Healthcare and Powers of Attorney for Financial Matters, please tell me who you would like to act as your agent for the following:

For Powers of Attorney for Healthcare, who would you like to handle decisions for you if something happens to you medically and you are unable to communicate (such as in the case of a stroke or other temporary incapacity)? (This document does not address life ending/life sustaining matters). This person is usually a spouse or a friend or close relative.


Would you like to name an alternate in the event something happens to your first choice? Though not necessary, you can name one or more alternates.



For Powers of Attorney for Financial Matters, who would you like to handle decisions for you while you are unable to communicate? This person will have access to your finances and can take care of your financial matters if you are incapacitated. This person is also usually a spouse or a friend or close relative.


Would you like to name an alternate in the event something happens to your first choice? Though not necessary, you can name one or more alternates.
